This Comprehensive Liability Disclaimer and Terms of Use ("Disclaimer") applies to all information, materials, predictions, research, communications, and services provided by Chambre, LLC, its management, affiliates, heirs, owners, associates, agents, employees, representatives, contractors, and all related parties without exception (collectively referred to as "Chambre," "we," "us," or "our"). This Disclaimer governs your use of all Chambre-associated prediction sites, research platforms, social media accounts, media firms, applications, and any other media platforms or channels (collectively, the "Platforms").
By accessing, reading, viewing, or utilizing any information, non-information, predictions, statements, or advice provided by Chambre across any of the Platforms, you (the "User," "you," or "your") acknowledge that you have read, understood, and expressly agree to be bound by the terms of this Disclaimer. If you do not agree to these terms, you must immediately cease all use of the Platforms and any associated materials.
All content, research, predictions, statements, and materials provided by Chambre are strictly for informational and educational purposes only. Nothing contained on the Platforms constitutes financial, investment, legal, tax, or accounting advice. Chambre does not provide personalized investment advice or act as a fiduciary. The information provided should not be construed as an offer to sell, a solicitation of an offer to buy, or a recommendation for any security, financial instrument, or investment strategy. You understand that the financial markets fluctuate and that the value of investments can decline. Chambre shall not be held responsible or liable for any investment decisions you make based upon the information, advice, predictions, or statements found on the Platforms.
To the maximum extent permitted by law, under no circumstances shall Chambre, its management, affiliates, heirs, owners, associates, agents, employees, or related parties be liable to you or any third party for any direct, indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages arising out of or relating to your use of, or inability to use, the Platforms, or any information, predictions, or research provided therein. This limitation of liability applies regardless of the legal theory under which such damages are sought, whether in contract, tort (including negligence), strict liability, or otherwise, even if Chambre has been advised of the possibility of such damages. This includes, but is not limited to, liability for lost profits, lost revenues, loss of data, loss of business opportunities, or any other financial losses.
You agree to fully indemnify, defend, and hold harmless Chambre, its management, affiliates, heirs, owners, associates, agents, employees, representatives, and all related parties without exception, from and against any and all claims, demands, actions, causes of action, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of, resulting from, or in any way connected with: (a) your use of or reliance upon any information, predictions, research, or statements provided on the Platforms; (b) your violation of any term of this Disclaimer; (c) your violation of any applicable laws, regulations, or third-party rights; or (d) any investment decisions or actions taken by you based on the content provided by Chambre.
Chambre maintains profiles and accounts on various social media platforms and third-party websites. All content posted on these platforms is subject to this Disclaimer. Interactions with third-party content, including "likes," "shares," or "retweets," do not constitute an endorsement or recommendation by Chambre. Furthermore, the Platforms may contain links to external websites or resources provided by third parties. These links are provided solely for your convenience. Chambre has no control over the content, accuracy, or privacy practices of these third-party sites and accepts no responsibility or liability for them or for any loss or damage that may arise from your use of them.
All research, predictions, and information provided by Chambre are granted to you under a limited, non-exclusive, non-transferable, individual one-seat license solely for your personal, non-commercial use. The sharing, forwarding, distribution, or publishing of any Chambre information, whether in whole or in part, is strictly prohibited.
By accessing the Platforms, you expressly agree that:
Chambre reserves the right, in its sole and absolute discretion, to terminate, suspend, or modify the Chambre research service, or any part thereof, at any time and without prior notice. Specifically, Chambre has the right to terminate the service with no liability at the end of any paid-for month. Furthermore, Chambre may elect to terminate the service immediately at any time; in the event of such immediate termination, Chambre's sole obligation and liability shall be to refund any pre-paid funds that are due to you for the unexpired portion of your subscription on a pro-rata basis.
This Disclaimer and your use of the Platforms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chambre, LLC is registered, without regard to its conflict of law principles. If any provision of this Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of this Disclaimer, and the remaining provisions shall continue in full force and effect.
This Disclaimer constitutes the entire agreement between you and Chambre regarding your use of the Platforms and the information provided therein, superseding any prior agreements or understandings. By accessing the Platforms, you warrant that you possess the legal capacity to enter into this agreement and that you have read, understood, and unconditionally accepted all the terms and conditions set forth in this Comprehensive Liability Disclaimer. You further acknowledge that you are waiving substantial legal rights, including the right to sue Chambre for any claims arising from your use of the provided information or non-information.
PredictNG will refund the monthly fee or prorated annual fee if the daily prediction misses the 1-day price range of natural gas more than 50% of the trading days of a month. For the purposes of this guarantee, a "HIT" is defined as a 1-day horizon prediction that falls within the actual daily high-low trading range of Henry Hub natural gas, as determined solely by Chambre's data sources and scoring methodology. A "miss" is any 1-day prediction that falls outside the actual daily trading range. The guarantee applies only to full calendar months of service performance, regardless of when your subscription begins. A full calendar month must have at least 20 trading days scored for the guarantee to apply. Partial months at the start or end of a subscription are not eligible. Only one guarantee claim may be submitted per eligible calendar month. For annual subscribers, the refund amount for an eligible month shall be calculated as the annual subscription fee divided by 12. Eligible refunds will be applied as a credit to the subscriber's next billing cycle, at Chambre's discretion. If the subscriber cancels, the credit will be issued as a refund to the original payment method. Refund or credit requests must be submitted within 30 days of the end of the applicable month. This guarantee does not apply during the 7-day free trial period. Chambre reserves the right to modify or discontinue this guarantee at any time with 30 days' written notice to active subscribers.
